Tory Lanez, the Canadian rapper who was found guilty by a Los Angeles jury of shooting Megan Thee Stallion in the feet during an altercation in July 2020, has now requested a new trial, almost two months after the verdict.
The Canadian native, whose real name is Daystar Peterson, was convicted on all three charges against him – assault with a semiautomatic firearm, carrying a loaded, unregistered firearm in a vehicle, and discharging a firearm with gross negligence. His sentencing hearing is set for April 10th, and he could face up to 22 years and eight months in state prison.
Tory’s lawyer, Jose Baez, claimed that prosecutors hurt his client’s case by showing a photo of the artist’s chest, which revealed a tattoo of a firearm, implying that he likes weapons. Tory’s lawyer also pointed out a lengthy interview between prosecutors and Kelsey Harris, Megan’s former friend who was in the car when she was shot. During the interview, Kelsey recanted many of the statements she made, which Jose claims should not have been presented in court.
The defense team also alleged that the prosecutors “painted defendant as a gun-wielding career criminal” and revealed their true motive when showing the shirtless photo of Tory.
They further claimed that Tory’s right to testify was “impermissibly chilled” when prosecutors warned they would bring up his lyrics and video for “Cap” if he took the stand. It’s reported, Tory is also making changes to his legal representation due to a scheduling conflict.
Megan Thee Stallion delivered an emotional testimony during the trial, saying that she was finding it difficult to open up. She said that she did not want to give the defendants the power that they had taken from her for the last three months. Tory Lanez is challenging his conviction on the grounds that prosecutors presented misleading evidence and made him out to be a violent person, depriving him of his due process. He is hoping to be granted a new trial. Prosecutors will likely respond to the appeal before his sentencing.
