House Speaker Nancy Pelosi said that Congress is ready to play a “prominent role” in deciding the winner of the election if the results are disputed.

- Pelosi told NPR, “We understand what the law is and the preeminence of the role of Congress and specifically the House of Representatives when it comes to counting the votes.” Congress would have a say in the election if a clear winner cannot be determined.

- According to Axios, President Trump has planned to declare victory on Election Day if he appears to be ahead. Despite this, Trump has denied this claim.
- President Trump has repeatedly made baseless claims regarding the validity of mail-in ballots and ballots being received after Election Day. Federal and state courts have already ruled in several elections whether or not ballots received after November 3 can be counted.
- In the event of an indecisive election, the House members vote as state delegations. The winner must obtain a simple majority of the state votes. As of now, Republicans control 26 delegations and Democrats control 22, but that can change with this election.
Joe Biden responded to the Axios report about Trump prematurely declaring victory and responded “the president is not going to steal this election”.
